Maui Supreme Court Case and It’s Impact on Discharge Permitting
In April, the U.S. Supreme Court issued an opinion that changes the way in which EPA determines whether a discharge permit is required. The County of Maui v. Hawaii Wildlife Fund case has the potential to impact discharges through the UIC program of the Safe Drinking Water Act, when there is a possibility of migration to navigable streams. This presentation addresses what Texas utilities should know about the decision, and how it may impact discharge permitting into the future.
Nathan Vassar is a Principal at Lloyd Gosselink Rochelle & Townsend, P.C. in Austin, TX. His practice focuses on assisting clients with enforcement defense matters, regulatory compliance, water quality matters, and water resources development. Mr. Vassar helps communities facing Clean Water Act compliance issues and represents clients in enforcement and civil litigation matters before federal and state courts and administrative agencies. Prior to the practice of law, Mr. Vassar worked in state politics as a Legislative Director for a State Senator in VA. and interned during law school with then-Tenth Circuit Judge Neil Gorsuch in Denver, CO. Mr. Vassar received his BA at the University of Virginia and his JD from the University of Texas School of Law.
